BNSS Section 507 — Irregularities which vitiate proceedings

यदि कोई मजिस्ट्रेट, जो निम्नलिखित बातों में से कोई बात विधि द्वारा इस... वे अनियमितताएं, निमित्त सशक्त न होते हुए, करता है तो उसकी कार्यवाही शून्य होगी, अर्थात् :-- जो कार्यवाही को दूषित करती हैं ।
(क) सम्पत्ति को धारा 85 के अधीन कुर्क करना और उसका विक्रय ;
(ख) किसी डाक प्राधिकारी की अभिरक्षा में के किसी दस्तावेज, पार्सल या अन्य चीज के लिए तलाशी-वारंट जारी करना ;
(ग) परिशान्ति कायम रखने के लिए प्रतिभूति की मांग करना ;
(घ) सदाचार के लिए प्रतिभूति की मांग करना ;
(ड) सदाचारी बने रहने के लिए विधिपूर्वक आबद्ध व्यक्ति को उन्मोचित करना ;
(च) परिशान्ति कायम रखने के बंधपत्र को रदूद करना ; (छ) भरणपोषण के लिए आदेश देना ; (ज) स्थानीय न्यूसेन्स के बारे में धारा 52 के अधीन आदेश देना ;
(झ) लोक न्यूसेन्स की पुनरावृत्ति या उसे चालू रखना धारा 62 के अधीन प्रतिषेध करना ;
(ज) अध्याय 4 के भाग ग या भाग घ के अधीन आदेश देना ;
(ट) किसी अपराध का धारा 20 की उपधारा (1) के खंड (ग) के अधीन संज्ञान करना ;
(ड) किसी अपराधी का संक्षेपत: विचारण करना ;
(ढ) किसी अन्य मजिस्ट्रेट द्वारा अभिलिखित कार्यवाही पर धारा 364 के अधीन दंडादेश पारित करना ;
(त) कार्यवाही को धारा 438 के अधीन मंगाना ; या
(थ) धारा 49। के अधीन पारित आदेश का पुनरीक्षण करना ।

If any Magistrate, not being empowered by law in this behalf, does any of the following things, namely:—
(a) attaches and sells property under section 85;
(b) issues a search-warrant for a document, parcel or other things in the custody of a postal authority;
(c) demands security to keep the peace;
(d) demands security for good behaviour;
(e) discharges a person lawfully bound to be of good behaviour;
(f) cancels a bond to keep the peace;
(g) makes an order for maintenance;
(h) makes an order under section 152 as to a local nuisance;
(i) prohibits, under section 162, the repetition or continuance of a public nuisance;
(j) makes an order under Part C or Part D of Chapter XI;
(k) takes cognizance of an offence under clause (c) of sub-section (1) of section 210;
(l) tries an offender;
(m) tries an offender summarily;
(n) passes a sentence, under section 364, on proceedings recorded by another Magistrate;
(o) decides an appeal;
(p) calls, under section 438, for proceedings; or
(q) revises an order passed under section 491, his proceedings shall be void.
