आदेश 21 नियम 46B — गारनिशी के विरुद्ध आदेश

जहां गारनिशी निर्णीतऋणी को उसके द्वारा शोध्य रकम या उसका इतना भाग जितना डिक्री की तुष्टि और निष्पादन के खर्चों को चुकाने के लिए पर्याप्त है तुरन्त न्यायालय में जमा नहीं करता है और उपसंजात नहीं होता है तथा सूचना के अनुसरण में कारण दर्शित नहीं करता है वहां न्यायालय गारनिशी को आदेश दे सकेगा कि वह ऐसी सूचना के निबन्धनों का अनुपालन करे और ऐसे आदेश पर निष्पादन इस प्रकार किया जा सकेगा मानो ऐसा आदेश उसके विरुद्ध डिक्री हो ।

Official text
Where the garnishee does not forthwith pay into Court the amount due from him to the judgment-debtor or so much thereof as is sufficient to satisfy the decree and the costs of execution, and does not appear and show cause in answer to the notice, the Court may order the garnishee to comply with the terms of such notice, and on such order, execution may issue as though such order were a decree against him.
