कमीशन निकालने वाला न्यायालय वह तारीख नियत करेगा जिसको या जिसके पूर्व कमीशन निष्पादन के पश्चात् उसको लौटाया जाएगा और इस प्रकार नियत की गई तारीख बढ़ाई नहीं जाएगी सिवाय उस दशा में जिसमें न्यायालय का, ऐसे कारणों से जो लेखबद्ध किए जाएंगे, यह समाधान हो जाता है कि तारीख बढ़ाने के लिए पर्याप्त हेतुक है ।]
