आदेश 26 नियम 5 — जो साक्षी भारत के भीतर नहीं है उसकी परीक्षा करने के लिए कमीशन या अनुरोधपत्र

जहां किसी ऐसे न्यायालय का जिसको किसी ऐसे स्थान में निवास करने वाले व्यक्ति की जो [भारत] के भीतर का स्थान नहीं है, परीक्षा करने का कमीशन निकालने के लिए आवेदन किया गया है, समाधान हो जाता है कि ऐसे व्यक्ति का साक्ष्य आवश्यक है वहां न्यायालय ऐसा कमीशन निकाल सकेगा या अनुरोधपत्र भेज सकेगा ।

Where any Court to which application is made for the issue of a commission for the examination of a person residing at any place not within 4[India] is satisfied that the evidence of such person is necessary, the Court may issue such commission or a letter of request.
