CPC Order 34 Rule 12 — Sale of property subject to prior mortgage
आदेश 34 नियम 12 — पूर्विक बन्धक के अधीन सम्पत्ति का विक्रय

जहां कोई सम्पत्ति जिसका विक्रय इस आदेश के अधीन निदिष्ट किया गया है, पूर्विक बन्धक के अधीन है वहां न्यायालय पूर्विक बन्धकदार की सहमति से यह निदेश दे सकेगा कि ऐसे पूर्विक बन्धकदार को विक्रय के आगमों में वही हित देकर जो विक्रीत सम्पत्ति में उसका था, उस सम्पत्ति का उस बन्धक से मुक्त करके विक्रय किया जाए ।

Where any property the sale of which is directed under this Order is subject to a prior mortgage, the Court may, with the consent of the prior mortgagee, direct that the propertybe sold free from the same, giving to such prior mortgagee the same interest in the proceeds of the sale as he had in the property sold.
