CPC Order 34 Rule 15 — Mortgages by the deposit of title deeds and charges

आदेश 34 नियम 15 — हक विलेखों के निक्षेप द्वारा बंधक और भार

[(1)] इस आदेश के वे सभी उपबन्ध जो साधारण बन्धक को लागू हैं, सम्पत्ति अन्तरण अधिनियम, 882 (882 का 4) की धारा 58 के अर्थ में हक विलेखों के निक्षेप द्वारा बन्धक को और धारा 00 के अर्थ में भार को, जहां तक हो सके, लागू होंगे ।
(2) जहां डिक्री में धन संदाय करने का आदेश दिया जाता है और उसके संदाय में व्यतिक्रम किए जाने पर उस डिक्री को स्थावर सम्पत्ति पर भारित किया जाता है वहां वह रकम उस डिक्री के निष्पादन में उस सम्पत्ति के विक्रय द्वारा वसूल की जा सकेगी ।]]

2[(1)] All the provisions contained in this Order which apply to a simple mortgage shall, so far as may be, apply to a mortgage by deposit of title-deeds within the meaning of section 58, and to a charge within the meaning of section 100 of the Transfer of Property Act, 1882 (4 of 1882); [(2) Where a decree orders payment of money and charges it on immovable property on default of payment, the amount may be realised by sale of that property in execution of that decree.]
