CPC Order 49 Rule 3 — Application of rules
आदेश 49 नियम 3 — नियमों का लागू होना

किसी भी चार्टरित उच्च न्यायलय को उसकी मामूली या गैर-मामूली आरम्भिक सिविल अधिकारिता का प्रयोग करने में निम्नलिखित नियम लागू नहीं होंगे, अर्थात् :--
(1) आदेश 7 के नियम 0 और नियम के खण्ड (ख) और खण्ड (ग) ; (2) आदेश 0 का नियम 3 ;
(3) आदेश 6 का नियम 2 ;
! 976 के अधिनियम सं० 04 की धारा 92 द्वारा (-2-977 से) उपनियम (1) के स्थान पर प्रतिस्थापित ।
(4) आदेश 8 के नियम 5, 6, 8, 9, 0, , 3, 4, 5 और 6 (जहां तक वे साक्ष्य लेने की रीति से
सम्बन्धित स्ी दर (5) आदेश 20 के नियम । से 8 तक के नियम ; तथा (6) आदेश 33 का नियम 7 (जहां तक वह ज्ञापन बनाने से सम्बन्धित है) ; और आदेश 4 का नियम 35 उसकी अपीली अधिकारिता के प्रयोग में किसी भी ऐसे उच्च न्यायालय को लागू नहीं होगा ।
Official text
The following rules shall not apply to any Chartered High Court in the exercise of its ordinary or extraordinary original civil jurisdiction, namely:—
(1) rule 10 and rule 11, clauses (b) and (c), of Order VII;
(2) rule 3 of Order X;
(3) rule 2 of Order XVI;
(4) rules 5, 6, 8, 9, 10, 11, 13, 14, 15 and 16 (so far as relates to the manner of taking evidence) of Order XVIII;
(5) rule 1 to 8 of Order XX; and
(6) rule 7 of Order XXXIII (so far as relates to the making of a memorandum), and rule 35 of Order XLI shall not apply to any such High Court in the exercise of its appellate jurisdiction.
