CPC Order 5 Rule 5 — Summons to be either to settle issues or for final disposal
आदेश 5 नियम 5 — समन या तो विवाद्यकों के स्थिरीकरण के लिए या अंतिम निपटारे के लिए होगा

न्यायालय समन निकालने के समय यह अवधारित करेगा कि क्या वह केवल विवाद्यकों के स्थिरीकरण के लिए होगा या वाद के अन्तिम निपटारे के लिए होगा और समन में तदनुसार निदेश अन्तर्विष्ट होगा :
परन्तु लघुवाद न्यायालय द्वारा सुने जाने वाले हर वाद में समन वाद के अंतिम निपटारे के लिए होगा ।
Official text
The Court shall determine, at the time of issuing the summons, whether it shall be for the settlement of issues only, or for the final disposal of the suit; and the summons shall contain a direction accordingly:
Provided that, in every suit heard by a Court of Small Causes, the summons shall be for the final disposal of the suit.
