किसी तथ्य की बात को, जिसकी विधि किसी पक्षकार के पक्ष में उपधारणा करती है या जिसके सबूत का भार प्रतिपक्ष पर है, पक्षकारों में से किसी के द्वारा किसी भी अभिवचन में अभिकथित करना तब तक आवश्यक न होगा जब तक कि पहले ही उसका प्रत्याख्यान विनिर्दिष्ट रूप से न कर दिया गया हो (उदाहरणार्थ जहां वादी दावे के सारभूत आधार के रूप में विनिमय-पत्र पर न कि उसके प्रतिफल के लिए वाद लाता है वहां विनिमय-पत्र का प्रतिफल) ।

Neither party need in any pleading allege any matter of fact which the law presumes in his favour or as to which the burden of proof lies upon the other side unless the same has first been specifically denied (e.g., consideration for a bill of exchange where the plaintiff sues only on the bill and not for the consideration as a substantive ground of claim).
