BNS Section 251 = IPC 214. Offering gift or restoration of property in consideration of screening offender
Full text (English)
(a) if the offence is punishable with death, be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine;
(b) if the offence is punishable with imprisonment for life or with imprisonment which may extend to ten years, be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine;
(c) if the offence is punishable with imprisonment not extending to ten years, be punished with imprisonment of the description provided for the offence for a term which may extend to one-fourth part of the longest term of imprisonment provided for the offence, or with fine, or with both.
Exception.—The provisions of this section and section 250 do not extend to any case in which the offence may lawfully be compounded.
पूरा पाठ (हिंदी)
(क) यदि वह अपराध मृत्यु से दंडनीय हो, तो वह दोनों में से किसी भांति के कारावास से, जिसकी अवधि सात वर्ष तक की हो सकेगी, दंडित किया जाएगा और जुर्माने का भी दायी होगा ;
(ख) यदि वह अपराध आजीवन कारावास से या दस वर्ष तक के कारावास से दंडनीय हो, तो वह दोनों में से किसी भांति के कारावास से, जिसकी अवधि तीन वर्ष तक की हो सकेगी, दंडित किया जाएगा और जुर्माने का भी दायी होगा ;
(ग) यदि वह अपराध दस वर्ष से कम के कारावास से दंडनीय हो, तो वह उस अपराध के लिए उपबंधित भांति के कारावास से इतनी अवधि के लिए, जो उस अपराध के लिए उपबंधित कारावास की दीर्घतम अवधि की एक-चौथाई तक की हो सकेगी, या जुर्माने से, या दोनों से, दंडित किया जाएगा ।
अपवाद--इस धारा और धारा 250 के उपबंध ऐसे किसी मामले को विस्तारित नहीं होते जिसमें अपराध का विधिपूर्वक शमन किया जा सके ।
