Full text (English)

(1) Whoever, with intent to cause the miscarriage of a woman with child, does any act which causes the death of such woman, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
(2) Where the act referred to in sub-section (1) is done without the consent of the woman, shall be punishable either with imprisonment for life, or with the punishment specified in said sub-section.
Explanation.—It is not essential to this offence that the offender should know that the act is likely to cause death.

पूरा पाठ (हिंदी)

(1) जो कोई, गर्भवती महिला का गर्भपात कारित करने के आशय से कोई ऐसा कार्य करता है, जिससे उस महिला की मृत्यु कारित हो जाती है, वह दोनों में से किसी भांति के कारावास से, जिसकी अवधि दस वर्ष तक की हो सकेगी, दण्डित किया जाएगा और जुर्माने का भी दायी होगा ।
(2) जहां उपधारा (1) में निर्दिष्ट कार्य उस महिला की सम्मति के बिना किया जाता है, वह आजीवन कारावास से, या उक्त उपधारा में विनिर्दिष्ट दण्ड से, दण्डित किया जाएगा ।
स्पष्टीकरण--इस अपराध के लिए यह आवश्यक नहीं है कि अपराधी जानता हो कि उस कार्य से मृत्यु कारित करना संभाव्य है ।
