Full text (English)
When in the course of the trial of a summons-case relating to an offence punishable with imprisonment for a term exceeding six months, it appears to the Magistrate that in the interests of justice, the offence should be tried in accordance with the procedure for the trial of warrant-cases, such Magistrate may proceed to re-hear the case in the manner provided by this Sanhita for the trial of warrant-cases and may recall any witness who may have been examined. पूरा पाठ (हिंदी)
जब किसी ऐसे अपराध से संबंधित समन-मामले के विचारण के दौरान जो छह मास से अधिक अवधि के कारावास से दंडनीय है, मजिस्ट्रेट को यह प्रतीत होता है कि न्याय के हित में उस अपराध का विचारण वारंट-मामलों के विचारण की प्रक्रिया के अनुसार किया जाना चाहिए तो ऐसा मजिस्ट्रेट वारंट-मामलों के विचारण के लिए इस संहिता द्वारा उपबंधित रीति से उस मामले की पुन: सुनवाई कर सकता है और ऐसे साक्षियों को पुन: बुला सकता है जिनकी परीक्षा की जा चुकी है ।
