Full text (English)
(1) The deposition of a civil surgeon or other medical witness, taken and attested by a Magistrate in the presence of the accused, or taken on commission under this Chapter, may be given in evidence in any inquiry, trial or other proceeding under this Sanhita, although the deponent is not called as a witness.
(2) The Court may, if it thinks fit, and shall, on the application of the prosecution or the accused, summon and examine any such deponent as to the subject-matter of his deposition.

पूरा पाठ (हिंदी)
(1) अभियुक्त की उपस्थिति में मजिस्ट्रेट द्वारा लिया गया और अनुप्रमाणित किया गया या इस अध्याय के अधीन कमीशन पर लिया गया, किसी सिविल सर्जन या अन्य चिकित्सीय साक्षी का अभिसाक्ष्य इस संहिता के अधीन किसी जांच, विचारण या अन्य कार्यवाही में साक्ष्य में दिया जा सकेगा, यद्यपि अभिसाक्षी को साक्षी के तौर पर नहीं बुलाया गया है ।
(2) यदि न्यायालय यह ठीक समझता है और अभियोजन या अभियुक्त के आवेदन
पर वह ऐसे किसी अभिसाक्षी को उसके अभिसाक्ष्य की विषयवस्तु के बारे में समन कर सकता है और उसकी परीक्षा करेगा ।
