Full text (English)
(1) Any Magistrate inquiring into or trying a case may permit the prosecution to be conducted by any person other than a police officer below the rank of inspector; but no person, other than the Advocate-General or Government Advocate or a Public Prosecutor or Assistant Public Prosecutor, shall be entitled to do so without such permission:
Provided that no police officer shall be permitted to conduct the prosecution if he has taken part in the investigation into the offence with respect to which the accused is being prosecuted.
(2) Any person conducting the prosecution may do so personally or by an advocate.

पूरा पाठ (हिंदी)
(1) किसी मामले की जांच या विचारण करने वाला कोई मजिस्ट्रेट, निरीक्षक की पंक्ति से नीचे के पुलिस अधिकारी से भिन्न किसी भी व्यक्ति द्वारा अभियोजन के संचालित किए जाने की अनुज्ञा दे सकेगा ; किन्तु महाधिवक्ता या सरकारी अधिवक्ता या लोक अभियोजक या सहायक लोक अभियोजक से भिन्न कोई व्यक्ति ऐसी अनुज्ञा के बिना ऐसा करने का हकदार न होगा :
परन्तु यदि पुलिस के किसी अधिकारी ने उस अपराध के अन्वेषण में, जिसके बारे में अभियुक्त का अभियोजन किया जा रहा है, भाग लिया है तो अभियोजन का संचालन करने की उसे अनुज्ञा नहीं दी जाएगी ।
(2) अभियोजन का संचालन करने वाला कोई व्यक्ति स्वयं या अधिवक्ता द्वारा ऐसा कर सकेगा ।
