Full text (English)
(1) When any person who, in the presence of a police officer, has committed or has been accused of committing a non-cognizable offence refuses on demand of such officer to give his name and residence or gives a name or residence which such officer has reason to believe to be false, he may be arrested by such officer in order that his name or residence may be ascertained.
(2) When the true name and residence of such person have been ascertained, he shall be released on a bond or bail bond, to appear before a Magistrate if so required:
Provided that if such person is not resident in India, the bail bond shall be secured by a surety or sureties resident in India.
(3) If the true name and residence of such person is not ascertained within twenty-four hours from the time of arrest or if he fails to execute the bond or bail bond, or, if so required, to furnish sufficient sureties, he shall forthwith be forwarded to the nearest Magistrate having jurisdiction.
(2) When the true name and residence of such person have been ascertained, he shall be released on a bond or bail bond, to appear before a Magistrate if so required:
Provided that if such person is not resident in India, the bail bond shall be secured by a surety or sureties resident in India.
(3) If the true name and residence of such person is not ascertained within twenty-four hours from the time of arrest or if he fails to execute the bond or bail bond, or, if so required, to furnish sufficient sureties, he shall forthwith be forwarded to the nearest Magistrate having jurisdiction.
पूरा पाठ (हिंदी)
(1) जब कोई व्यक्ति जिसने पुलिस अधिकारी की उपस्थिति में असंज्ञेय अपराध किया है या जिस पर पुलिस अधिकारी की उपस्थिति में असंज्ञेय अपराध करने का अभियोग लगाया गया है, उस अधिकारी की मांग पर अपना नाम और निवास बताने से इंकार करता है या ऐसा नाम या निवास बताता है, जिसके बारे में उस अधिकारी को यह विश्वास करने का कारण है कि वह मिथ्या है, तब वह ऐसे अधिकारी द्वारा इसलिए गिरफ्तार किया जा सकता है कि उसका नाम और निवास अभिनिश्चित किया जा सके ।
(2) जब ऐसे व्यक्ति का सही नाम और निवास अभिनिश्चित कर लिया जाता है, तब वह इस बंधपत्र या जमानतपत्र पर छोड़ दिया जाएगा कि यदि उससे मजिस्ट्रेट के समक्ष उपस्थित होने की अपेक्षा की गई तो वह उसके समक्ष उपस्थित होगा :
परंतु यदि ऐसा व्यक्ति भारत में निवासी नहीं है तो वह जमानतपत्र भारत में निवासी प्रतिभू या प्रतिभुओं द्वारा प्रतिभूत किया जाएगा ।
(3) यदि गिरफ्तारी के समय से चौबीस घंटों के भीतर ऐसे व्यक्ति का सही नाम और निवास अभिनिश्चित नहीं किया जाता है या यदि वह बंधपत्र या जमानतपत्र निष्पादित करने में या यदि ऐसी अपेक्षा की जाए, पर्याप्त प्रतिभू देने में असफल रहता है तो वह अधिकारिता रखने वाले निकटतम मजिस्ट्रेट के पास तत्काल भेज दिया जाएगा ।

परंतु यदि ऐसा व्यक्ति भारत में निवासी नहीं है तो वह जमानतपत्र भारत में निवासी प्रतिभू या प्रतिभुओं द्वारा प्रतिभूत किया जाएगा ।
