Full text (English)
(1) Affidavits shall be confined to such facts as the deponent is able of his own knowledge to prove, except on interlocutory applications, on which statements of his belief may be admitted: provided that the grounds thereof are stated.
(2) The costs of every affidavit which shall unnecessarily set forth matters of hearsay or argumentative matter, or copies of or extracts from documents, shall (unless the Court otherwise directs) be paid by the party filing the same. Jammu and Kashmir and Ladakh (UTs).— STATE AMENDMENT In Order XIX of the Code, after Rule 3, insert the following new rules, namely4. Court may control evidence.—(1) The court may, by directions, regulate the evidence as to issues on which it requires evidence and the manner in which such evidence may be placed before the court.
(2) The court may, in its discretion and for reasons to be recorded in writing, exclude evidence that would otherwise be produced by the parties.

(1) शपथपत्र ऐसे तथ्यों तक ही सीमित होंगे जिनको अभिसाक्षी अपने निजी ज्ञान से साबित करने में समर्थ है, किन्तु अन्तर्वर्ती आवेदनों के शपथपत्रों में उसके विश्वास पर आधारित कथन ग्राह्म हो सकेंगे:
परन्तु यह तब जब कि उनके लिए आधारों का कथन किया गया हो ।
' 976 के अधिनियम सं० 04 की धारा 69 द्वारा (-2-977 से) पूर्ववर्ती नियम के स्थान पर प्रतिस्थापित । 2 [976 के अधिनियम सं ० 04 की धारा 69 द्वारा (-2-977 से) अंतःस्थापित । 3 [999 के अधिनियम सं ० 46 की धारा 27 द्वारा (-7-2002 से) अंतःस्थापित ।
(2) जिस शपथपत्र में अनुश्रुत या तार्किक बातें या दस्तावेंजों की प्रतियां या दस्तावेजों के उद्धरण अनावश्यक रूप से दर्ज किए गए हैं, ऐसे हर एक शपथपत्र के खर्चे (जब तक कि न्यायालय अन्यथा निदेश न करे) उन्हें फाइल करने वाले पक्षकार द्वारा दिए जाएंगे ।
