BNSS Section 36 — Procedure of arrest and duties of officer making arrest

Every police officer while making an arrest shall— (b) prepare a memorandum of arrest which shall be— (a) bear an accurate, visible and clear identification of his name which will facilitate easy identification; (i) attested by at least one witness, who is a member of the family of the person arrested or a respectable member of the locality where the arrest is made; (ii) countersigned by the person arrested; and In (c) inform the person arrested, unless the memorandum is attested by a member of his family, that he has a right to have a relative or a friend or any other person named by him to be informed of his arrest.
प्रत्येक पुलिस अधिकारी, गिरफ्तारी करते समय,-- (क) अपने नाम की सही, इृश्यमान और स्पष्ट पहचान धारण करेगा, जिससे उसकी आसानी से पहचान हो सके ; (ख) गिरफ्तारी का एक ज्ञापन तैयार करेगा, जो-- (1) कम से कम एक साक्षी द्वारा अनुप्रमाणित किया जाएगा, जो गिरफ्तार किए गए व्यक्ति के कुटुंब का सदस्य है या उस परिक्षेत्र का, जहां गिरफ्तारी की गई है, प्रतिष्ठित सदस्य है ; ही) गिरफ्तार किए गए व्यक्ति द्वारा प्रतिहस्ताक्षरित किया जाएगा ; और (ग) जब तक उसके कुटुंब के किसी सदस्य द्वारा ज्ञापन को अनुप्रमाणित न कर दिया गया हो, गिरफ्तार किए गए व्यक्ति को यह सूचना देगा कि उसे यह अधिकार है कि उसके किसी नातेदार या मित्र को, जिसका वह नाम दे, उसकी गिरफ्तारी की सूचना दी जाए ।
