BNSS Section 504 — Procedure where no claimant appears within six months
(1) If no person within such period establishes his claim to such property, and if the person in whose possession such property was found is unable to show that it was legally acquired by him, the Magistrate may by order direct that such property shall be at the disposal of the State Government and may be sold by that Government and the proceeds of such sale shall be dealt with in such manner as the State Government may, by rules, provide. (2) An appeal shall lie against any such order to the Court to which appeals ordinarily lie from convictions by the Magistrate.
(1) यदि ऐसी अवधि के भीतर कोई व्यक्ति सम्पत्ति पर अपना दावा सिद्ध नहीं करे और वह व्यक्ति जिसके कब्जे में ऐसी सम्पत्ति पाई गई थी, यह दर्शित करने में असमर्थ है कि वह उसके द्वारा वैध रूप से अर्जित की गई थी, तो मजिस्ट्रेट आदेश द्वारा निदेश दे सकेगा कि ऐसी सम्पत्ति राज्य सरकार के व्ययन के अधीन होगी तथा उस सरकार द्वारा विक्रय की जा सकेगी और ऐसे विक्रय के आगमों के संबंध में ऐसी रीति से कार्यवाही की जा सकेगी जो राज्य सरकार, नियमों द्वारा, उपबंधित करे । (2) किसी ऐसे आदेश के विरुद्ध अपील उस न्यायालय में होगी जिसमें साधारणतया मजिस्ट्रेट द्वारा की गई दोषसिद्धि के विरुद्ध अपीलें होती हैं ।
