BSA Section 114 — Proof of good faith in transactions where one party is in relation of active confidence
Where there is a question as to the good faith of a transaction between parties, one of whom stands to the other in a position of active confidence, the burden of proving the good faith of the transaction is on the party who is in a position of active confidence. Illustrations. (a) The good faith of a sale by a client to an advocate is in question in a suit brought by the client. The burden of proving the good faith of the transaction is on the advocate. (b) The good faith of a sale by a son just come of age to a father is in question in a suit brought by the son. The burden of proving the good faith of the transaction is on the father.
जहां उन पक्षकारों के बीच के संव्यवहार के सदूभाव के बारे में प्रश्न है, जिनमें वे एक-दूसरे के प्रति सक्रिय विश्वास की स्थिति में हैं, वहां उस संव्यवहार के सद्ृभाव को साबित करने का भार उस पक्षकार पर है जो सक्रिय विश्वास की स्थिति में है। दृष्टांत (क) मुवक्किल द्वारा अधिवक्ता के पक्ष में किए गए विक्रय का सद्भाव मुवक्किल द्वारा लाए गए वाद में प्रश्नगत है । संव्यवहार का सद्भाव साबित करने का भार अधिवक्ता पर है । (ख) पुत्र द्वारा, जो कि हाल ही में वयस्क हुआ है, पिता को किए गए किसी विक्रय का सदूभाव पुत्र द्वारा लाए गए वाद में प्रश्नगत है । संव्यवहार के सद्भाव को साबित करने का भार पिता पर है ।
