BSA Section 167 — Using, as evidence, of document production of which was refused on notice
When a party refuses to produce a document which he has had notice to produce, he cannot afterwards use the document as evidence without the consent of the other party or the order of the Court. Illustration. A sues B on an agreement and gives B notice to produce it. At the trial, A calls for the document and B refuses to produce it. A gives secondary evidence of its contents. B seeks to produce the document itself to contradict the secondary evidence given by A, or in order to show that the agreement is not stamped. He cannot do so.
जब कोई पक्षकार ऐसे किसी दस्तावेज को प्रस्तुत करने से इन्कार कर देता है, जिसे प्रस्तुत करने की उसे सूचना मिल चुकी है, तब वह तत्पश्चात् उस दस्तावेज को दूसरे पक्षकार की सम्मति के या न्यायालय के आदेश के बिना साक्ष्य के रूप में उपयोग में नहीं ला सकेगा । ख पर किसी करार के आधार पर क वाद लाता है और वह ख को उसे प्रस्तुत करने की सूचना देता है । विचारण में क उस दस्तावेज की मांग करता है और ख उसे प्रस्तुत करने से इंकार करता है । क उसकी अन्तर्वस्तु का द्वितीयक साक्ष्य देता है । क द्वारा दिए हुए दुवितीयक साक्ष्य का खण्डन करने के लिए या यह दर्शित करने के लिए कि वह करार स्टाम्पित नहीं है, ख दस्तावेज को ही प्रस्तुत करना चाहता है । वह ऐसा नहीं कर सकता ।
