BSA Section 80 — Presumption as to Gazettes, newspapers, and other documents
The Court shall presume the genuineness of every document purporting to be the Official Gazette, or to be a newspaper or journal, and of every document purporting to be a document directed by any law to be kept by any person, if such document is kept substantially in the form required by law and is produced from proper custody. Explanation.—For the purposes of this section and section 92, document is said to be in proper custody if it is in the place in which, and looked after by the person with whom such document is required to be kept; but no custody is improper if it is proved to have had a legitimate origin, or if the circumstances of the particular case are such as to render that origin probable.
न्यायालय प्रत्येक ऐसे दस्तावेज का असली होना उपधारित करेगा, जिसका राजपत्र होना, या समाचारपत्र या जर्नल होना तात्पर्यित है और प्रत्येक ऐसे दस्तावेज का, जिसका ऐसा दस्तावेज होना तात्पर्यित है, जिसका किसी व्यक्ति द्वारा रखा जाना किसी विधि द्वारा निदेशित है, यदि ऐसा दस्तावेज सारत: उस प्ररूप में रखा गया है, जो विधि द्वारा अपेक्षित है, और उचित अभिरक्षा में से प्रस्तुत किया गया है । स्पष्टीकरण--इस धारा और धारा 92 के प्रयोजनों के लिए, कोई दस्तावेज उचित अभिरक्षा में रखा गया कहा जाता है, यदि वह उस स्थान में रखा गया है, जिसमें उस व्यक्ति द्वारा उसका ध्यान रखा जाता है, जिसके पास ऐसा दस्तावेज रखा जाना अपेक्षित है ; किंतु कोई अभिरक्षा अनुचित नहीं है, यदि इसका वैध उत्पन्न होना साबित होता है, या किसी विशेष…
