BSA Section 99 — Evidence as to application of language which can apply to one only of several persons
When the facts are such that the language used might have been meant to apply to any one, and could not have been meant to apply to more than one, of several persons or things, evidence may be given of facts which show which of those persons or things it was intended to apply to. Illustrations. (a) A agrees to sell to B, for one thousand rupees, “my white horse”. A has two white horses. Evidence may be given of facts which show which of them was meant. (b) A agrees to accompany B to Ramgarh. Evidence may be given of facts showing whether Ramgarh in Rajasthan or Ramgarh in Uttarakhand was meant. Illustration.
जब तथ्य ऐसे हैं कि प्रयुक्त भाषा कई व्यक्तियों या चीजों में से किसी एक को लागू होने के लिए अभिप्रेत हो सकती थी, और एक से अधिक को लागू होने के लिए अभिप्रेत नहीं हो सकती थी, तब उन तथ्यों का साक्ष्य दिया जा सकेगा, जो यह दर्शित करते हैं कि उन व्यक्तियों या चीजों में से किस को लागू होने के लिए वह आशयित थी। (क) क एक हजार रुपए में “मेरा सफेद घोड़ा” ख को बेचने का करार करता है । क के पास दो सफेद घोड़े हैं । उन तथ्यों का साक्ष्य दिया जा सकेगा जो यह दर्शित करते हों कि उनमें से कौन सा घोड़ा अभिप्रेत था । (ख) ख के साथ क रामगढ़ जाने के लिए करार करता है । यह दर्शित करने वाले तथ्यों का साक्ष्य दिया जा सकेगा कि राजस्थान का रामगढ़ अभिप्रेत था या उत्तराखंड का रामगढ़ ।
