BNS Section 206 — Absconding to avoid service of summons or other proceeding
Whoever absconds in order to avoid being served with a summons, notice or order proceeding from any public servant legally competent, as such public servant, to issue such summons, notice or order,— (a) shall be punished with simple imprisonment for a term which may extend to one month, or with fine which may extend to five thousand rupees, or with both; (b) where such summons or notice or order is to attend in person or by agent, or to produce a document or an electronic record in a Court shall be punished with simple imprisonment for a term which may extend to six months, or with fine which may extend to ten thousand rupees, or with both.
जो कोई, किसी ऐसे लोक सेवक दू्वारा निकाले गए समन, सूचना या आदेश की तामील से बचने के लिए फरार हो जाता है, जो ऐसे लोक सेवक के नाते ऐसे समन, सूचना या आदेश को निकालने के लिए वैध रूप से सक्षम हो, -- (क) वह सादा कारावास से, जिसकी अवधि एक मास तक की हो सकेगी, या जुर्माने से, जो पांच हजार रुपए तक का हो सकेगा, या दोनों से, दंडित किया जाएगा ; (ख) समन या सूचना या आदेश किसी न्यायालय में स्वयं या अभिकर्ता द्वारा उपस्थित होने के लिए, या दस्तावेज या इलैक्ट्रानिक अभिलेख प्रस्तुत करने के लिए है, तो वह सादा कारावास से, जिसकी अवधि छह मास तक की हो सकेगी, या जुर्माने से, जो दस हजार रुपए तक का हो सकेगा, या दोनों से, दण्डित किया जाएगा ।
