Whoever, being a public servant, legally bound as such public servant to apprehend or to keep in confinement any person charged with or liable to be apprehended for an offence, intentionally omits to apprehend such person, or intentionally suffers such person to escape, or intentionally aids such person in escaping or attempting to escape from such confinement, shall be punished,— (a) with imprisonment of either description for a term which may extend to seven years, with or without fine, if the person in confinement, or who ought to have been apprehended, was charged with, or liable to be apprehended for, an offence punishable with death; or (b) with imprisonment of either description for a term which may extend to three years, with or without fine, if the person in confinement, or who ought to have been apprehended, was charged with, or liable to be apprehended for, an offence…
कोई ऐसा लोक सेवक होते हुए, जो किसी अपराध के लिए आरोपित या पकड़े जाने के दायित्व के अधीन किसी व्यक्ति को पकड़ने या परिरोध में रखने के लिए सेवक के नाते विधिक रूप से आबद्ध है, ऐसे व्यक्ति को पकड़ने का साशय लोप करता है या ऐसे परिरोध में से ऐसे व्यक्ति का निकल भागना साशय सहन करता है या ऐसे व्यक्ति के निकल भागने में या निकल भागने के लिए प्रयत्न करने में साशय मदद करता है, वह निम्नलिखित रूप से दंडित किया जाएगा,-- (क) यदि परिरुदूध व्यक्ति या जो व्यक्ति पकड़ा जाना चाहिए था वह मृत्यु से दंडनीय अपराध के लिए आरोपित या पकड़े जाने के दायित्व के अधीन हो, तो वह जुर्माने सहित या रहित दोनों में से किसी भांति के कारावास से, जिसकी अवधि सात वर्ष तक की हो सकेगी ; या (ख) यदि परिरुदूध व्यक्ति या जो व्यक्ति पकड़ा…
