BNS Section 17 — Act done by a person justified, or by mistake of fact believing himself justified, by law
Nothing is an offence which is done by any person who is justified by law, or who by reason of a mistake of fact and not by reason of a mistake of law in good faith, believes himself to be justified by law, in doing it. Illustration. A sees Z commit what appears to A to be a murder. A, in the exercise, to the best of his judgment exerted in good faith, of the power which the law gives to all persons of apprehending murderers in the fact, seizes Z, in order to bring Z before the proper authorities. A has committed no offence, though it may turn out that Z was acting in self-defence.
कोई बात अपराध नहीं है, जो ऐसे व्यक्ति द्वारा किया जाए, जो उसे करने के लिए विधि द्वारा न्यायानुमत है, या तथ्य की भूल के कारण, न कि विधि की भूल के कारण सदूभावपूर्वक विश्वास करता है कि वह उसे करने के लिए विधि द्वारा न्यायानुमत है । क, य को ऐसा कार्य करते हुए देखता है, जो क को हत्या प्रतीत होता है । क सदूभावपूर्वक काम में लाए गए अपने श्रेष्ठ निर्णय के अनुसार उस शक्ति को प्रयोग में लाते हुए, जो विधि ने हत्या करने वालों को उस कार्य में पकड़ने के लिए समस्त व्यक्तियों को दे रखी है, य को उचित प्राधिकारियों के समक्ष ले जाने के लिए य को अभिगृहीत करता है । क ने कोई अपराध नहीं किया है, चाहे तत्पश्चात् असल बात यह निकले कि य आत्म-रक्षा में कार्य कर रहा था ।
