Full text (English)
(1) Any person on whose application any Court other than a High Court has refused to make a complaint under sub-section (1) or sub-section (2) of section 379, or against whom such a complaint has been made by such Court, may appeal to the Court to which such former Court is subordinate within the meaning of sub-section (4) of section 215, and the superior Court may thereupon, after notice to the parties concerned, direct the withdrawal of the complaint, or, as the case may be, making of the complaint which such former Court might have made under section 379, and, if it makes such complaint, the provisions of that section shall apply accordingly.

पूरा पाठ (हिंदी)
(1) कोई व्यक्ति, जिसके आवेदन पर उच्च न्यायालय से भिन्न किसी न्यायालय ने धारा 379 की उपधारा (1) या उपधारा (2) के अधीन परिवाद करने से इंकार कर दिया है या जिसके विरुद्ध ऐसा परिवाद ऐसे न्यायालय द्वारा किया गया है, उस न्यायालय में अपील कर सकेगा, जिसके ऐसा पूर्वकथित न्यायालय धारा 25 की उपधारा (4) के अर्थ में अधीनस्थ है और तब वरिष्ठ न्यायालय संबद्ध पक्षकारों को सूचना देने के पश्चात्, यथास्थिति, उस परिवाद को वापस लेने का या वह परिवाद करने का जिसे ऐसा पूर्वकथित न्यायालय धारा 379 के अधीन कर सकता था, निदेश दे सकेगा और यदि वह ऐसा परिवाद करता है तो उस धारा के उपबंध तद्नुसार लागू होंगे ।
(2) इस धारा के अधीन आदेश, और ऐसे आदेश के अधीन रहते हुए धारा 379 के अधीन आदेश, अंतिम होगा और उसका पुनरीक्षण नहीं किया जाएगा ।
