Full text (English)

(1) Every police officer or other person making any arrest under this Sanhita shall forthwith give the information regarding such arrest and place where the arrested person is being held to any of his relatives, friends or such other persons as may be disclosed or nominated by the arrested person for the purpose of giving such information and also to the designated police officer in the district.
(2) The police officer shall inform the arrested person of his rights under sub-section (1) as soon as he is brought to the police station.
(3) An entry of the fact as to who has been informed of the arrest of such person shall be made in a book to be kept in the police station in such form as the State Government may, by rules, provide.
(4) It shall be the duty of the Magistrate before whom such arrested person is produced, to satisfy himself that the requirements of sub-section (2) and sub-section (3) have been complied with in respect of such arrested person.

पूरा पाठ (हिंदी)

(1) इस संहिता के अधीन कोई गिरफ्तारी करने वाला प्रत्येक पुलिस अधिकारी या अन्य व्यक्ति, ऐसी गिरफ्तारी और उस स्थान के बारे में, जहां गिरफ्तार किया गया व्यक्ति रखा जा रहा है, जानकारी, उसके मित्रों, नातेदारों या ऐसे अन्य व्यक्ति को जिसे गिरफ्तार किए गए व्यक्ति द्वारा ऐसी जानकारी देने के प्रयोजन के लिए प्रकट या नामनिर्दिष्ट को तथा जिले में पदाभिहित पुलिस अधिकारी को भी तुरंत देगा ।
(2) पुलिस अधिकारी गिरफ्तार किए गए व्यक्ति को, जैसे ही वह पुलिस थाने में लाया जाता है, उपधारा (1) के अधीन उसके अधिकारों के बारे में सूचित करेगा ।
(3) इस तथ्य की प्रविष्टि कि ऐसे व्यक्ति की गिरफ्तारी की सूचना किसे दी गई है, पुलिस थाने में रखी जाने वाली पुस्तक में ऐसे प्ररूप में, जो राज्य सरकार दू्‌वारा इस निमित्त विहित किया जाए, की जाएगी ।
(4) उस मजिस्ट्रेट का, जिसके समक्ष ऐसे गिरफ्तार किया गया व्यक्ति, प्रस्तुत किया जाता है, यह कर्तव्य होगा कि वह अपना समाधान करे कि उपधारा (2) और उपधारा (3) की अपेक्षाओं का ऐसे गिरफ्तार किए गए व्यक्ति के संबंध में अनुपालन किया गया है ।
