BNSS Section 148 — Dispersal of assembly by use of civil force
(1) Any Executive Magistrate or officer in charge of a police station or, in the absence of such officer in charge, any police officer, not below the rank of a sub-inspector, may command any unlawful assembly, or any assembly of five or more persons likely to cause a disturbance of the public peace, to disperse; and it shall thereupon be the duty of the members of such assembly to disperse accordingly. (2) If, upon being so commanded, any such assembly does not disperse, or if, without being so commanded, it conducts itself in such a manner as to show a determination not to disperse, any Executive Magistrate or police officer referred to in sub-section (1), may proceed to disperse such assembly by force, and may require the assistance of any person, not being an officer or member of the armed forces and acting as such, for the purpose of dispersing such assembly, and, if necessary,…
(1) कोई कार्यपालक मजिस्ट्रेट या पुलिस थाने का भारसाधक अधिकारी या ऐसे भारसाधक अधिकारी की अनुपस्थिति में उप निरीक्षक की पंक्ति से अनिम्न कोई पुलिस अधिकारी किसी विधिविरुद्ध जमाव को, या पांच या अधिक व्यक्तियों के किसी ऐसे जमाव को, जिससे लोकशांति विक्षुब्ध होने की संभाव्यता है, तितर-बितर होने का समादेश दे सकता है और तब ऐसे जमाव के सदस्यों का यह कर्तव्य होगा कि वे तदनुसार तितर-बितर हो जाएं । (2) यदि ऐसा समादेश दिए जाने पर ऐसा कोई जमाव तितर-बितर नहीं होता है या यदि ऐसे समादिष्ट हुए बिना वह इस प्रकार से आचरण करता है, जिससे उसका तितर- बितर न होने का निश्चय दर्शित होता है, तो उपधारा (1) में निर्दिष्ट कोई कार्यपालक मजिस्ट्रेट या पुलिस अधिकारी उस जमाव को बल द्वारा तितर-बितर करने की कार्यवाही कर सकेगा…
