BSA Section 23 — Confession to police officer
(1) No confession made to a police officer shall be proved as against a person accused of any offence. (2) No confession made by any person while he is in the custody of a police officer, unless it is made in the immediate presence of a Magistrate shall be proved against him: Provided that when any fact is deposed to as discovered in consequence of information received from a person accused of any offence, in the custody of a police officer, so much of such information, whether it amounts to a confession or not, as relates distinctly to the fact discovered, may be proved.
(1) किसी पुलिस अधिकारी से की गई कोई भी संस्वीकृति, किसी अपराध के अभियुक्त व्यक्ति के विरुद्ध साबित नहीं की जाएगी । (2) कोई भी संस्वीकृति, जो किसी व्यक्ति ने उस समय की हो जब वह पुलिस अधिकारी की अभिरक्षा में है, उसके विरुद्ध तब तक साबित नहीं की जाएगी, जब तक कि वह मजिस्ट्रेट की साक्षात् उपस्थिति में न की गई हो : परन्तु जब किसी तथ्य के बारे में यह अभिसाक्ष्य दिया जाता है कि किसी अपराध के अभियुक्त व्यक्ति से, जो पुलिस अधिकारी की अभिरक्षा में है, प्राप्त जानकारी के परिणामस्वरूप उसका पता चला है, तब ऐसी जानकारी में से, उतनी चाहे वह संस्वीकृति की कोटि में आती हो या नहीं, जितनी पता चले हुए तथ्य से स्पष्टतया संबंधित है, साबित की जा सकेगी ।
